Risk & Medical Disclaimer / Waiver

By proceeding with your booking and participating in a ThrillVana expedition, you (the “Participant”) acknowledge, understand, and voluntarily agree to the following binding terms and disclosures:

1. Nature of High-Altitude Expeditions

• I understand that ThrillVana expeditions take place in remote, high-altitude Himalayan regions (reaching altitudes of ~15,000 ft or more) where oxygen levels are significantly lower than at sea level.

• I acknowledge that these regions have limited infrastructure, primitive medical facilities, and are subject to extreme weather fluctuations and difficult terrain.

2. Explicit Acknowledgement of Health Risks

• I am fully aware of the life-threatening risks associated with high altitude, specifically Acute Mountain Sickness (AMS), High Altitude Pulmonary Edema (HAPE), and High Altitude Cerebral Edema (HACE).

• I accept the inherent physical risks of mountain travel, including but not limited to: rockslides, falls, injuries during transit on rugged roads, and exposure to extreme cold.

3. Medical Fitness & Personal Disclosure

• I confirm that I am physically and mentally fit for the rigors of this journey. I have consulted a qualified medical professional regarding my suitability for high-altitude trekking.

• I have disclosed all pre-existing medical conditions (including heart, respiratory, or blood pressure issues) to ThrillVana in writing.

• Waiver: I understand that withholding medical information increases my personal risk and fully releases ThrillVana from any related liability or claims.

4. Travel Insurance & Financial Responsibility

• Insurance Advisory: I understand that specialized travel insurance covering high-altitude trekking and emergency helicopter evacuation is strongly recommended for this expedition.

• Assumption of Risk: I acknowledge that ThrillVana does not provide medical or travel insurance.

• Financial Waiver: If I choose to travel without insurance, I explicitly accept full and sole financial responsibility for all costs related to emergency evacuation, rescue, specialized transport, and medical treatment. I confirm that ThrillVana shall have no obligation to fund or manage these expenses on my behalf.

5. Absolute Authority of the Expedition Leader

• I agree to follow all safety protocols provided by the ThrillVana team.

• I acknowledge that the Expedition Leader has the final authority to terminate my participation or order an immediate descent if my health or the group’s safety is at risk.

• I understand that such safety-based decisions are final and do not entitle me to any refund or compensation.

6. Limitation of Liability

• I voluntarily release Rigasava Advisory Services Private Limited, its directors, employees, and partners from any and all liability for personal injury, illness, death, or loss/damage to personal property (including cameras and electronics) during the expedition.

• I understand that ThrillVana is not responsible for disruptions caused by “Acts of God” (landslides, cloudbursts, weather) or sudden government/military restrictions in border zones.

7. Emergency Coordination

• In the event of an emergency, ThrillVana will assist in coordinating rescue efforts to the best of its ability. However, I acknowledge that evacuation in remote areas is subject to weather conditions, military permissions, and aircraft availability, and is not guaranteed.

8. Voluntary Acceptance

• I confirm that my participation is entirely voluntary. I have read and understood this disclaimer in its entirety. I agree that this waiver shall be legally binding upon me, my heirs, and my legal representatives.
